1. Agreement to these terms
This website is operated by Makush Art Gallery, a trading name of Habesha Merkato L.L.C., a limited liability company registered in the United States (“the Gallery”, “we”, “us”). By browsing this site or purchasing from it, you agree to these Terms of Service. If you do not agree, please do not use the site.
2. Artworks and accuracy
The works offered here are original, one-of-a-kind artworks unless stated otherwise. We take care to present each piece accurately, but colours can vary between screens and stated dimensions are approximate. Product listings may be created from the Gallery’s social media posts; where a listing and its photographs differ, the photographs of the actual work prevail.
3. Pricing and payment
Prices are shown in US dollars and may change without notice until an order is completed. An order is only accepted once payment has been received and an order confirmation issued. We may cancel and fully refund any order affected by an obvious pricing or listing error.
4. Availability of unique works
Because most works are unique, availability cannot be guaranteed until your purchase is confirmed. If a work turns out to be unavailable — for example, it was sold at the gallery or through another channel before the site could be updated — we will cancel the order and refund you in full promptly.
5. Shipping and delivery
Shipping arrangements, costs and timelines are communicated at checkout or agreed with you after purchase. International shipments may be subject to import duties and taxes, which are the buyer’s responsibility unless stated otherwise. Risk in the artwork passes to you on delivery.
6. Returns and refunds
If a work arrives damaged, contact us within 7 days of delivery with photographs and we will make it right through repair, replacement where possible, or refund. For other return requests, contact us and we will do our best to find a fair solution; where local consumer law grants you additional rights, those rights are unaffected by these terms.
7. Intellectual property
All artwork images, text and other content on this site remain the property of the Gallery and the respective artists. Purchasing a physical artwork does not transfer copyright in it. You may not reproduce site content for commercial purposes without written permission.
8. Acceptable use
You agree not to misuse the site — including attempting to gain unauthorised access, interfering with its operation, or using it for unlawful purposes.
9. Third-party services
The site may link to or display content from third-party services, including social media platforms such as Instagram. Those services have their own terms and privacy practices, which we do not control.
10. Liability
To the fullest extent permitted by law, the Gallery’s liability in connection with any purchase is limited to the amount you paid for that purchase, and we are not liable for indirect or consequential losses. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Changes and governing law
We may update these terms from time to time; the version published on this page applies at the time of your visit or purchase. These terms are governed by the laws of the jurisdiction in which the Gallery is established, unless mandatory consumer law provides otherwise.
